Article 1 (Intended Purpose)
These terms define the conditions set forth by Sharp Corporation (hereinafter “the Company”) regarding the use by customers (hereinafter “Users”) of the information service (hereinafter “the Service”) for the Company’s “J-STAY” smartphone rental service support site (hereinafter “the Site”).
Article 2 (Compliance with / Application of Terms)
- Under these terms, Users refers to any customer who uses the Service upon agreeing to the terms defined herein.
- Users who click on the consent button displayed on the screen will be considered as having consented to these terms.
- The Company reserves the right to change these terms at any time without prior notification to Users if such changes are deemed necessary. Once the changes have been applied, the updated terms will be enforced.
- Users are required to agree to these terms in order to use the Service and, therefore, cannot claim not having been aware of or not having agreed to the terms defined herein.
Article 3 (Provision, Termination, Etc. of the Service)
- The Service provides the following:
Links to Google Play, the application distribution site operated by Google Inc., and to other third-party sites, and information on applications (hereinafter referred to as “Apps”) distributed on Google Play. (Information provided by the Company through the Service is collectively referred to as “Content”.)
- Users are responsible for all communication fees, etc. when using the Service.
- The Company may limit the types of devices and mobile phones that can use the Service.
Moreover, the Company may restrict some functionality even for supported devices/models.
- The Company reserves the right to change, suspend, or cancel the Service without prior notification to Users.
Users will have no course for objecting to the changes, suspension, or cancellation of the Service, and will be prohibited from making any claim to the Company for damages resulting from such decisions.
Article 4 (Prohibited User Actions)
- Users are prohibited from the following actions while using the Service (including through the use of Apps).
Moreover, the Company reserves the right to take appropriate measures if it deems there is a possibility that Users will engage in any of the following actions.
- Circumventing technical limitations
- Using, providing, etc. any programs, etc. that eliminate or obstruct functions (including software and hardware) for other Users, the Company, or third parties through the Service
- Actions that are harmful to other Users, App developers, the Company, third parties, or the Service itself
- Tampering with the Content
- Actions designed to generate profit through the Service or in relation to the Service without proper consent
- Actions that infringe on copy rights or other intellectual property rights of other Users, App developers, the Company, or third parties
- Actions in violation of any laws or regulations
- Actions contrary to public order and morals, or acts that provide information contrary to public order and morals
- Actions that slander, defame, discredit, or otherwise harm other Users, App developers, the Company, or third parties
- Actions that violate the privacy of other Users or third parties
- Actions that result in the collection or accumulation information such as personal information and historical information of other Users without permission
- Actions that infringe on the property of other Users, App developers, the Company, or third parties
- Actions related to election campaigns or similar behaviors
- Criminal actions or actions related to criminal actions
- Actions related to religions, such as religious solicitations and missionary activities, etc.
- Actions that disable or disrupt the functionality of the Company’s servers or network
- Actions that interfere with the Company’s services or distributed advertisements, and services and advertisements provided on the Company website
- Actions designed for purposes other than the purpose of the Service
- Actions that utilize the Service to provide profit directly or indirectly to antisocial forces
- Actions of or related to decompiling, disassembling, or reverse engineering
- Actions that transfer the rights and obligations related to use of the Service as described in these terms to a third party, or providing those rights or obligations as collateral or as successions
- Other actions deemed inappropriate by the Company
Article 5 (Copyright Handling)
- The copyrights, trademarks, expertise, and other intellectual property rights in Apps provided on Google Play and introduced through the Service belong to Google or the individual App developer.
- Users are prohibited from using Apps beyond the scope of personal use by an individual user as specified by copyright law in accordance with the usage conditions for Apps provided on Google Play unless otherwise permitted.
Article 6 (User Responsibilities)
- Any User of the Service that causes the Company to suffer damages shall bear such damages incurred by the Company (including various expenses such as attorney fees).
- If use of the Service result in Users causing harm to other Users, App developers, or third parties, or causes a dispute between Users and other Users, App developers, or third parties, resolution shall be at the Users' own costs and responsibility.
Article 7 (Liability Exemption)
- The Company assumes no responsibility regarding the completeness, accuracy, correctness, usefulness, purpose-specific suitability, or other aspects of the Content provided by the Service. Moreover, the Company will not be responsible for any damages incurred by Users or third parties due to the Content.
- The Company does not guarantee that the Content and Apps introduced through the Service are devoid of operational or rights-related flaws or bugs.
- The Company assumes no responsibility regarding concerns arising between Users and other Users, App developers, or third parties. In such instances, Users shall be responsible for solving concerns at their own expense.
- The Company provides links to Google Play and other sites through the Service, but the Company assumes no responsibility for the provisions, content, etc. of applications provided on Google Play or third-party sites. Therefore, Users shall use Google Play and other third-party sites at their own risk.
- The Company assumes no responsibility for problems resulting from any User not adhering to the provisions of Article 4 (Prohibited User Actions) or Article 5 (Copyright Handling).
- Some Apps may provide content that may be considered obscene, uncomfortable, or problematic. Because Apps are obtained based upon the choice of the User, the Company assumes no responsibility for such Apps.
- The Company reserves the right to change or delete Content as it sees fit without prior notification and without the consent of Users. The Company assumes no responsibility for any problems or damages that arise from such changes or deletions.
- In situations where the Company is legally liable for damages, the Company shall not be responsible for damages beyond what is considered socially normal (so-called “normal damages”) for the non-fulfillment of an obligation or for the offense.
Article 8 (Personal Information)
The Company will not disclose personal information (information that can be used to identify individuals) obtained over the course of managing the System—such as through responses to inquiries from Users, etc.—to a third party without the consent of the User. However, this does not apply in the following cases.
- When a User has agreed to disclosing the personal information.
- When disclosure is required by law or by lawful request of a government agency.
- When disclosure to a subcontractor handling operation of the Site has been deemed necessary to maintain operation.
However, note that the Company takes appropriate measures to ensure the personal information of Users is protected even in such situations and is fully responsible for any subcontractor used.
Article 9 (Governing Laws and Jurisdiction)
In regard to the establishment, effectiveness, applicability, and interpretation of these terms, Japanese law applies at all times, and any disputes arising from these terms shall be subjected to the jurisdiction of the courts of Japan.
